Civil disputes in Mumbai are, more often than not, disputes about premises — who owns them, who may remain in them, and on what terms. This page sets out the civil proceedings undertaken at these chambers.
Suits relating to property
Suits for declaration of title, for possession, and for permanent and temporary injunction; suits for specific performance of an agreement under the Specific Relief Act, 1963; and suits for partition among co-owners and heirs.
Tenancy and leave and licence
Proceedings under the Maharashtra Rent Control Act, 1999 between landlords and tenants, and proceedings relating to leave and licence agreements, including recovery of possession on the expiry of a licence.
Cooperative housing society disputes
Disputes under the Maharashtra Cooperative Societies Act, 1960 — transfer of shares and membership, nomination and transmission on the death of a member, election disputes, recovery of dues, and disputes over redevelopment — before the Registrar and the Cooperative Court.
Succession, wills and probate
Drafting of wills; applications for succession certificates, letters of administration and probate; and transmission of shares in a cooperative housing society and of other assets to heirs and nominees.
Documentation
Drafting and vetting of agreements for sale, conveyance deeds, deeds of gift and release, partnership deeds, development agreements, leave and licence agreements, powers of attorney and trust deeds, and attendance for registration.
Cheque dishonour and recovery
Complaints and defence under Section 138 of the Negotiable Instruments Act, 1881, and civil suits for the recovery of money.
Consumer and real estate complaints
Complaints before the District Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, and complaints before MahaRERA against promoters under the Real Estate (Regulation and Development) Act, 2016.
