Criminal proceedings in India are now governed by the Bharatiya Nyaya Sanhita, 2023, the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Bharatiya Sakshya Adhiniyam, 2023, which replaced the Indian Penal Code, the Code of Criminal Procedure and the Indian Evidence Act with effect from 1 July 2024. Matters registered before that date continue under the earlier codes, so a good many files now run on both sets of provisions at once. This page describes the proceedings undertaken at these chambers, for complainants and for accused persons alike.
Bail and anticipatory bail
Applications for bail, and applications for pre-arrest bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, before the Magistrate’s Court and the Sessions Court at Dindoshi. These are usually the most time-sensitive step in any criminal file and are attended to as such.
Offences relating to marriage and dowry
Cruelty to a married woman by her husband or his relatives is dealt with by Sections 85 and 86 of the Bharatiya Nyaya Sanhita, 2023, which correspond to Section 498A of the Indian Penal Code. Dowry death is dealt with by Section 80. The Dowry Prohibition Act, 1961 continues to apply to the giving, taking and demanding of dowry. Both the prosecution of such complaints and the defence of persons accused in them are undertaken.
Offences against women and children
Proceedings under the provisions of the Bharatiya Nyaya Sanhita, 2023 relating to offences against women, and under the Protection of Children from Sexual Offences Act, 2012, before the designated courts.
Cheating, breach of trust and property offences
Complaints and defence in matters of cheating, criminal breach of trust, forgery and criminal intimidation, which in Mumbai frequently arise out of property transactions, business arrangements, and disputes within trusts and societies.
Complaints and trials
Private complaints before the Magistrate; representation of the complainant during investigation and trial; and defence at every stage from remand to judgment.
