A nikah is valid under Muslim personal law when it is properly solemnised. But for a passport, a visa, a bank, an insurer, or a maintenance or inheritance claim, you will usually need a government marriage certificate, not only the nikahnama. In Mumbai, a nikah is registered with the Registrar of Marriages at the BMC ward office under the Maharashtra Regulation of Marriage Bureaus and Registration of Marriages Act, 1998.

Nikahnama and marriage certificate: the difference

  • The nikahnama is the record of the nikah under personal law, usually signed by the qazi, the bride and groom (or their representatives) and the witnesses. It records the mehr.
  • The marriage certificate is issued by the Registrar after registration under the 1998 Act. This is the document most authorities ask for.

Step by step

  1. Keep the nikahnama safe, and get a certified English translation if it is in Urdu.
  2. Fill the application on the BMC (MCGM) portal or at the ward office. The system generates the memorandum of marriage.
  3. Sign the memorandum. The husband, the wife, three witnesses and the person who solemnised the nikah sign in the boxes provided.
  4. Visit the ward office where you live on the appointment day, with originals and copies of all documents. The husband, wife and witnesses attend.
  5. Collect the certificate after verification and registration.

Documents usually needed

  • The memorandum, signed as above
  • The nikahnama, with an English translation if it is in Urdu
  • Age proof of husband and wife (birth certificate, school leaving certificate or passport)
  • Identity and address proof of husband, wife and each of the three witnesses
  • Passport-size photographs and a photograph of the nikah
  • Details of the qazi or person who solemnised the nikah
  • For a previously married party, the divorce papers or death certificate of the former spouse

Time limit

The memorandum should be filed within 90 days of the nikah. A marriage can still be registered later on payment of a higher fee, and the Registrar may ask for an explanation of the delay. Fees are revised from time to time, so check the current schedule at the ward office.

If one partner is not Muslim

A marriage between a Muslim and a non-Muslim who do not marry under personal law can be solemnised and registered under the Special Marriage Act, 1954. See court marriage in Mumbai.

Why registering matters for women

A registered marriage makes it far easier to prove the marriage later, whether for maintenance, a residence order, a claim for mehr, custody, or inheritance. Women are often advised to register promptly for that reason. See khula and divorce for Muslim women and maintenance.

Frequently asked questions

Is the nikahnama enough as proof of marriage?

It is evidence of the nikah, but passport offices, embassies and many institutions ask for the Registrar’s certificate.

How many witnesses are needed?

The nikah itself requires witnesses under personal law. For registration at the BMC ward office, three witnesses sign Form D and attend.

Can we register a nikah that took place years ago?

Yes, on payment of the higher late fee and with an explanation for the delay.

Can the nikah be registered if the qazi is not available?

The application asks for particulars of the person who solemnised the nikah. If that person cannot be traced, take advice on what the ward office will accept instead.
