If a police case has been registered at Malvani, Malad, Kurar, Charkop or another nearby police station, the case will usually be heard by a Metropolitan Magistrate at the Borivali courts. For many people this is their first time in court. This guide explains, step by step, how to find your court and date, what happens on the dates, and what to carry.
Key facts
- Criminal cases from Malad and Malvani
- Metropolitan Magistrates’ courts, Borivali; each police station’s cases go to a particular court number
- Serious cases and sessions bail
- City Civil and Sessions Court, Dindoshi
- Check your case online
- eCourts: services.ecourts.gov.in or the eCourts Services app, using the CNR number, case number or FIR number
- Always carry
- Summons or notice, ID proof, copies of earlier orders, and your bail papers if on bail
Step 1: Find your court number and next date
- Your summons, notice or bail order shows the court number and the date.
- Online: on eCourts (services.ecourts.gov.in, or the eCourts Services mobile app), search by the CNR number, the case number, or the FIR number and police station. You can see the next date, the stage of the case and the orders passed.
- The court’s cause list (the list of cases for the day) is also on eCourts. Check it the evening before.
Step 2: What happens on the dates
- Appearance: the accused answers the summons. If arrested earlier and released on bail, the bail bond continues.
- Chargesheet: after the police file the chargesheet, the accused is given copies of the police papers.
- Framing of charge or notice: the court explains the accusation, and the accused pleads guilty or not guilty.
- Evidence: the prosecution examines its witnesses; the defence cross-examines; the accused’s statement is recorded; defence evidence, if any.
- Arguments and judgment.
Many dates are adjourned. Keep a written note of every date and what happened.
If you are the complainant or a victim
- You can ask the court for copies of the chargesheet and orders, and keep track of the case on eCourts.
- If the police file a closure report, you can file a protest petition before the Magistrate.
- In domestic violence cases, the application is filed directly before the Magistrate. See how to file a DV case.
Do not miss a date
If the accused does not appear without a good reason, the court can issue a warrant and the bail can be cancelled. If you cannot attend, your advocate should apply for exemption for that date, with a reason (for example, a medical certificate).
Bail and sureties
- For bail, the court usually asks for a personal bond and one or more sureties with ID and address proof, and sometimes proof of the surety’s income or property.
- Anticipatory bail in serious cases is sought from the Sessions Court at Dindoshi or the High Court. See anticipatory bail.
- If you received a police notice to appear, read police notice under Section 35 BNSS.
Certified copies of orders
You will often need a certified copy of an order or judgment, for an appeal, a passport or a job. See certified copies of court orders in Mumbai. The time taken to get a certified copy is excluded from the time to appeal.
Cases that are not heard at Borivali
- Cheque bounce (Section 138) cases are often filed at other Magistrate centres, depending on the bank branch and the complaint.
- Divorce, custody and maintenance under family law go to the Family Court at Bandra Kurla Complex.
- Civil suits go to the City Civil Court (including its Dindoshi branch) or the Small Causes Court.
